Informed Consent for Telehealth Service & Data Processing

Welcome to &you! Before you can use our health services, we need you to review and agree to two important consents. The first is for the use of telehealth as a medical service. The second is your explicit consent for us to process your sensitive health data in compliance with the Data Privacy Act of 2012 (DPA).

Informed Consent for Telehealth Service

This section explains the risks and benefits of receiving medical care through a digital platform.

  • Purpose: The purpose of this section is to obtain your informed consent to receive healthcare services from licensed providers ("Providers") using the platform ("Service").
  • Use of Telehealth: Telehealth involves delivering healthcare using electronic communications between a provider and a patient who are not in the same physical location. This may may include, but is not limited to, one or more of the following:
    • Electronic transmission of medical records, photo images, personal health information, or other data between a patient and a provider.
    • Interactions between a patient and provider via audio, video, and/or data communications (such as messaging or email communications)
    • Use of output data from medical devices, sound, and video files.

    Alternative methods of care may be available to you, such as in-person services, and you may choose an alternative at any time. Always discuss alternative options with your Provider.

  • Anticipated Benefits: The benefits of telehealth include easier access to care, convenience, and the ability to consult with a provider from your home.
    • Making it easier and more efficient for you to access medical care or other services and treatment for the conditions treated by your Provider(s).
    • Allowing you to obtain medical care or other services and treatment by Provider(s) at times that are convenient for you.
    • Enabling you to interact with Provider(s) without the necessity of an in-office appointment.
    • Participation in mental health services may reduce stress and anxiety, decrease negative thoughts, improve relationships, and increase comfort in different settings.
  • Potential Risks: The risks of telehealth include the possibility of technology failures, delays in evaluation, and a provider's inability to perform a full physical examination, which could limit their diagnostic capabilities.

Possible risks or side effects vary and are dependent on the specific medication or treatment administered. Detailed information about these risks and side effects will be provided with each medication. These risks include, but may not be limited to:

    • The quality, accuracy, or effectiveness of the services you receive from your Provider could be limited.
    • Failures of technology may impact your Provider(s)’ ability to correctly diagnose or treat your condition.
    • Delays in medical evaluation/treatment could occur due to unavailability of your Provider(s) or technological failures.
    • The electronic systems or security protocols used may fail, causing a breach of privacy of your medical or other information.
    • Data transmitted electronically may be more susceptible to unintended disclosure of protected health information to third parties.
    • A lack of access to all of your medical records may result in adverse drug interactions, allergic reactions, or other judgment errors.

By proceeding, you acknowledge that you have provided accurate and factual personal information. You acknowledge the potential risks and side effects associated with the treatment, and you agree to follow the physician’s instructions. 

  • Emergencies: The &you platform is not for emergencies. If you are experiencing a life-threatening situation, please call the National Emergency hotline at 911 or your local emergency number.
  • Laboratory Products and Services: Certain healthcare services provided to you by Providers via the Service may require that you complete an at-home diagnostic test. These diagnostic tests are provided by third-party laboratories, and neither Rx Ventures Pte, Ltd. nor your Provider(s) can guarantee the accuracy or reliability of these tests.

Acknowledgment for Telehealth Service: By using the platform, you acknowledge that you have read and understood the risks and benefits of using telehealth for your medical care.

Explicit Consent for Data Processing (DPA Consent)

This section asks for your specific permission to process your personal and sensitive health information in accordance with the Philippine Data Privacy Act of 2012.

  • Purpose of Processing: We will process your data for the following specific purposes: to provide you with telehealth consultations, to facilitate electronic prescriptions, and to securely store your medical history for your use on our platform.
  • Data to be Collected: We will collect your Personal Details (i.e name, contact info) and your Sensitive Personal Information (i.e health history, consultation notes, prescriptions).
  • Data Sharing: For our platform to deliver its full experience, we must share your data with specific partners under a legal agreement. This includes sharing your prescription data with our partner pharmacies and your test requests with our partner laboratories. A full, up-to-date list of our partners is available at [&you/our-partners].
  • Data Retention: In compliance with the Department of Health regulations, your medical records will be securely stored for seven (7) years from your last consultation, after which they will be destroyed in a secure manner that would prevent further processing, unauthorized access, disclosure to any other party or the public, or prejudice the interests of the data subjects.
  • Your Rights: As a data subject, you have the right to be Informed, to Object, to Access, to Rectify, to Erasure or Blocking, to Damages, to Data Portability, and to File a Complaint with the National Privacy Commission (NPC).

Acknowledgement for Data Processing: By using the platform, I acknowledge that I have provided accurate personal information, read the foregoing and expressly consent to the processing of my personal and sensitive health data.
